1. Programme conditions

This website is provided to support Rio Tinto Diamonds’ Diavik SourcedTM Chain of Custody programme (Programme).

The Programme is based on a proprietary chain of custody system, managed by Rio Tinto Diamonds’ independent auditors, RSM Astute.

The Programme aims to keep rough diamond production from Rio Tinto’s Diavik Diamond Mine separate from all other sources, and to continue the traceability and segregation of production at all stages of the pipeline, up to the point of delivery to the customer. To achieve this objective, all participating entities, including both diamond and jewellery manufacturers, must be certified by Rio Tinto Diamonds’ independent auditor and subsequently ensure strict compliance with the terms of the Programme at all operations.

Only certified entities can participate in the Programme. Certification, or re- certification for continuing participants, will be conducted by Rio Tinto Diamonds’ appointed auditor. Certification involves the following process:

  1. An audit is conducted of nominated entities and operations to identify risks at all stages of goods handling;
  2. A tailored manual is prepared by the auditor to define the appropriate controls to be put in place at the relevant operations;
  3. These controls must be built into the processes at the operations to mitigate risks; and
  4. The auditor will design an ongoing certification process to ensure management of risks is carried out through regular audits.

Participants must subsequently maintain and be able to provide an auditable track record of all Diavik diamonds processed and sold by them as part of the Programme.

Authenticity Documents
Each Diavik SourcedTM Authenticity Card or Origin Report (Authenticity Document) is issued on the basis that each participant complies with Programme conditions in relation to the segregation and tracking of diamonds, and provides accurate information, as set out above.

However, while all reasonable efforts are made by the independent auditors to ensure compliance, no representations, warranties or guarantees, express or implied, are given by Rio Tinto Diamonds in relation to the diamonds, or jewellery set with the diamonds, purchased by any consumer, or in relation to the accuracy of any Authenticity Document, and such are excluded to the fullest extent permitted by law.

Neither Rio Tinto Diamonds, nor RSM Astute, shall be liable for any loss, damage or expense arising out of or in connection with any purchase of diamonds or jewellery set with diamonds, sold under the Programme, or any use of or reliance on any Authenticity Document or the Authentication service provided on this website and, in particular, neither party shall not be liable for any loss of profits, loss of business or any special, indirect, incidental, exemplary, punitive, statutory, or consequential damages, including lost profits, arising out of or in connection with the above. The above limitation of liability extends to every other person to whom the Authenticity Document or Authentication service report is distributed or shown and each is provided on that basis.

The above exclusions and limitations apply only to the extent permitted by law.

2. Information

All data on this website is provided for information only. Rio Tinto Diamonds has made reasonable efforts to ensure that information provided on this website is accurate at the time of inclusion. However, the materials appearing on the website could include technical, typographical or photographic errors.

Rio Tinto Diamonds makes no representations or warranties of any kind about the information provided on this website, or via hypertext links, or any other item used either directly or indirectly from this website and reserves the right to make changes and corrections at any time, without notice (but will not be obliged to do so). Any decisions based on such information are the sole responsibility of the visitor.

We take reasonable steps to protect the security of information that we exchange with you via the website. However, please be aware that there are inherent risks in transmitting information by use of the Internet and other online or electronic transmission systems. 6. Data privacy statement

When you use the website, you may choose to provide personal data to Rio Tinto Diamonds and companies in the Rio Tinto Group (for example, by completing an online form). We won’t process that personal data for other purposes except where required to meet our legal obligations or otherwise as authorised by law and notified to you. We will retain data for the period needed to operate the website and to comply with our legal obligations.

If you provide personal data through the website, Rio Tinto Diamonds will be the data controller for the purposes of data privacy laws. Your personal data will also be processed and stored by Rio Tinto offices in Australia, where this website is hosted by a third party vendor, and in any country where Rio Tinto or its external service providers operate. Where Rio Tinto Diamonds shares personal information with other companies in the Rio Tinto group or with third party service providers who are located in countries outside of the European Economic Area, we will ensure that the information is transferred in accordance with this statement and as permitted by applicable law on data protection.
